1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Lyko AI LLC, a Florida limited liability company doing business as LexiMap ("LexiMap," "we," "us," or "our"). By creating an account, accessing, or using the LexiMap application (the "Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

If you are creating an account on behalf of a minor, you represent and warrant that you are the child's parent or legal guardian and that you consent to these Terms on the child's behalf. You accept full responsibility for the child's use of the Service.

2. Description of Service

LexiMap is a vocabulary training application designed for students in grades 4–12. The Service uses spaced repetition and interactive exercises to teach Latin and Greek word roots. The Service is provided as a Progressive Web App (PWA) accessible through web browsers.

The Service is continually evolving. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, including but not limited to: available content, game modes, features, supported devices, and the number of child profiles permitted under a single account.

3. Eligibility

You must be at least 18 years of age to create an account on the Service. The Service is intended for use by parents and legal guardians of children in grades 4–12 who reside in the United States. By creating an account, you represent and warrant that you meet these eligibility requirements.

4. Accounts

To use the Service, you must create a parent account using a valid email address. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

Parent accounts may create child profiles. Each child profile is associated with and controlled by the parent account. Parents are responsible for supervising their children's use of the Service.

Single-Household Use. Your account is for personal, non-commercial use by you and children within your immediate household only. You may not share your account credentials with other families, teachers, tutoring centers, schools, or organizations. Each household must maintain its own subscription.

Monitoring & Enforcement. We reserve the right to monitor usage patterns — including concurrent device sessions, IP address diversity, and geolocation — to detect account sharing or misuse. If we determine, at our sole discretion, that an account is being shared or misused, we may: (a) issue a warning, (b) restrict account access, (c) terminate the account, or (d) require purchase of additional subscriptions. These remedies are non-sequential and any may be applied directly. No refund will be provided for enforcement actions taken under this section.

5. Subscriptions, Billing & Auto-Renewal

The Service offers free trial access and paid subscription plans. By subscribing to a paid plan, you agree to the following:

  • Free Trial: New accounts may receive a free trial period. The duration and availability of free trials are determined at our sole discretion and may vary. You will not be charged during the trial. If you do not subscribe before the trial ends, access to premium features will be restricted.
  • Subscription Plans: Current subscription plans and pricing are available on our Pricing page. We reserve the right to introduce, modify, or retire plans at any time. Plan features, pricing, and limits are subject to change.
  • Auto-Renewal: SUBSCRIPTION PLANS AUTOMATICALLY RENEW AT THE END OF EACH BILLING CYCLE (MONTHLY OR ANNUALLY, DEPENDING ON THE PLAN SELECTED) UNLESS YOU CANCEL BEFORE THE RENEWAL DATE. YOU AUTHORIZE US TO CHARGE YOUR PAYMENT METHOD ON FILE AT THE THEN-CURRENT RATE AT THE START OF EACH RENEWAL PERIOD.

  • Price Changes: We may change subscription prices with at least 30 days' notice via the email address associated with your account. Your continued use of the Service or failure to cancel after a price change takes effect constitutes acceptance of the new price.
  • Cancellation: You may cancel your subscription at any time through the Parent Dashboard. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.
  • Refund Policy: All recurring subscription payments are final and non-refundable. No prorated refunds are provided for partial billing periods. Lifetime plan purchases are refundable within seven (7) days of the original purchase date only. If you believe a charge is incorrect, please contact us at [email protected] before initiating a chargeback with your bank or payment provider so that we can attempt to resolve the issue directly.
  • Payment Processing: All payments are processed securely by Stripe. We do not store your credit card information on our servers. Your use of Stripe is subject to Stripe's Terms of Service.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to access the Service (bots, scrapers, etc.)
  • Share your account credentials with third parties
  • Use the Service for any commercial purpose, including but not limited to reselling access, operating a tutoring business, or providing access to students outside your immediate household without an institutional license
  • Create multiple accounts to circumvent free trial limitations, usage limits, or enforcement actions
  • Access the Service from an excessive number of devices or locations inconsistent with reasonable household use
  • Generate unreasonable or disproportionately large load on our infrastructure

7. Intellectual Property

All content in the Service — including vocabulary items, exercises, illustrations, audio recordings, and software — is owned by Lyko AI LLC or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written permission.

You retain no ownership rights in any content generated through your use of the Service (e.g., session data, mastery scores).

Aggregated Data License. By using the Service, you grant us a non-exclusive, royalty-free, worldwide license to use anonymized and aggregated data derived from your use of the Service for service improvement, feature development, and educational research purposes. This data will never be sold to third parties and will never be presented in a personally identifiable form.

8. Indemnification

You agree to indemnify, defend, and hold harmless Lyko AI LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property, privacy, or publicity rights; or (d) any content or information you provide through the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or free from harmful components.

LexiMap is an educational supplement and is not a substitute for school instruction, tutoring, or standardized test preparation courses. We do not guarantee specific test score improvements or educational outcomes.

The Service is under active development. Features, content, and functionality may change, be added, or be removed without prior notice. We do not guarantee that any specific feature will remain available.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LYKO AI LLC OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU ACTUALLY PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY DOLLARS ($50.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

11. Dispute Resolution and Arbitration

Informal Resolution. Before filing any formal proceeding, you agree to first contact us at [email protected] and attempt to resolve the dispute informally for at least thirty (30) days.

Binding Arbitration. If the dispute is not resolved informally, you and Lyko AI LLC agree to resolve it through final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration shall be conducted in the State of Florida. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

CLASS ACTION WAIVER: YOU AND LYKO AI LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.

Small Claims Exception. Notwithstanding the above, either party may bring an individual action in small claims court in the State of Florida if the claim falls within the court's jurisdictional limits.

Opt-Out. You may opt out of the arbitration and class action waiver provisions of this section by sending written notice to [email protected] within thirty (30) days of first accepting these Terms. Your notice must include your name, email address associated with your account, and a clear statement that you wish to opt out of arbitration.

12. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms — including any enforcement actions taken under Section 4 (Accounts) — or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. You may request deletion of your data as described in our Privacy Policy.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. For any dispute not subject to arbitration under Section 11, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Florida.

14. Changes to Terms

We may modify these Terms at any time. The current version number and date are displayed at the top of this page. We will notify registered users by email of material changes at least fifteen (15) days before they take effect. For subscription price changes, the notice period specified in Section 5 applies. Your continued use of the Service after the effective date of revised Terms constitutes acceptance of the changes.
